Recent changes in the employment-based immigration process may accelerate the labor certification process but severely restrict its use. However, if an individual can establish that he or she fits into one of the categories profiled on this page, a visa can still be granted.

This section serves as a brief introduction to the visa choices available to foreign professors, scholars, and researchers. It is not intended to replace legal advice and should not be relied upon, especially since immigration laws and regulations change frequently.

OUTSTANDING RESEARCHERS and PROFESSORS
To obtain this approval, you must establish that your academic work is original and significant and that you are recognized internationally as outstanding in your academic field. You must also have at least three years of experience in teaching and/or research in your field; and have an offer of permanent employment from a United States employer to conduct research or to teach.

NATIONAL INTEREST WAIVER of LABOR CERTIFICATIONS
To obtain an NIW approval you must establish by strong quantitative evidence that your research directly serves the national interest to a substantially greater degree than would an available U.S. worker having the same minimum qualifications; that you are superior to other researchers in your field; and that you have a degree of influence on the field as a whole.

Individuals within this category do not need a job offer, provided they can establish that they will continue to work in their field of expertise.

SPECIAL HANDLING for UNIVERSITY PROFESSORS
You can qualify for this fast-track processing if you have received a permanent, full-time teaching position at a university or college. The school must submit evidence of competitive recruitment and the selection process that was undertaken. The school must also show that you are more qualified than any U.S. workers who applied for the job.

Please note: The application must be submitted within 18 months of the date on which the official offer of employment was first made.

PERSONS of EXTRAORDINARY ABILITY (EB1-1)
You qualify for this category if you are one of the few who has risen to the very top of your field and your ability has been demonstrated by sustained national or international acclaim and achievements in your field. This category is usually limited to senior-level faculty and researchers.

Individuals within this category do not need a job offer to immigrate to the U.S. provided they can establish that they will continue to work in their field of expertise.
